PAYING OF STATE COMPENSATION TO CRIME VICTIMS

"Law of paying of state compensation to crime victims" gives the possibility to apply for compensation of material loss in case of severe crimes against individuals that were executed after January 1 in the year 2001.

Compensation is paid in case the crime result the victim has received a profound bodily injury, a health disorder that has lasted for at least six months or in case the victim has died because of the crime.

50% of the expenditure below is compensated in case of:

* the loss due to the incapability for work;
* the victim's medical treatment costs;
* the victim's funeral costs;
* the loss resulting from the death of the victim (to one dependant of the victim is paid as compensation 25% of and to two or more dependants of the victim is paid the total of 50% of the victim's previous average income from which was deducted the social tax);
* the cost of glasses, false teeth, contact lenses and other accessories, replacing bodily functions and of clothes in case the total sum of loss exceeds 50% of the person's income of the month, preceding the moment of becoming the crime victim.

Maximal amount of the compensation is 50 000 kroons.

Generally the compensation can be applied for within a year after the crime.

Applying for the compensation presupposes starting of a criminal case by the police. Severity of the crime (for example, whether the case can be defined as profound bodily injury or not) is ascertained by court medical examination. After compiling of the court medical examination act it is required to turn to the Pension Department according to the place of residence.

For applying for the compensation must be presented:

* an application;
* passport (aliens with a valid residence permit);
* power of attorney and/ or court decision regarding adjudging of guardianship (in case the compensation application is signed by the applicant's representative);
* birth certificate of the child (in case the victim or dependant is a minor and the compensation application is presented by the victim's parent);
* documents, certifying covering of the medical treatment costs and total sum of medical treatment expenses;
* victim's or his/her legal representative's written explanation regarding the necessity of expenses, enlisted in the previous article (separately for all expenses);
* court decision or formal certificate of the investigation body of the crime circumstances.

* In case of the victim's death the victim's death certificate and documents, certifying covering of the funeral costs by the dependant or the dependant's representative and total sum of the costs.

* In case of temporary incapacity for work certificate of the doctor, having issued the work incapability document or in case of perishing or losing of the doctor's medical document the certificate of the Health Insurance Fund of the duration of temporary incapability for work.

* In case of proclaiming the person to be permanently incapable for work the certificate of the State Employment Board of the registration of the applicant as a job seeker or person's written confirmation of not working (in case there was no income from what was deducted the social tax).

Additional documents, required for calculating of the loss that was caused to glasses, false teeth, contact lenses and other accessories, replacing bodily functions are:

- list of the mentioned accessories and clothes with repair and acquisition cost (application form is given by the Pension Department);
- documents, certifying covering of mentioned costs.

If more than a year has passed from the crime of violance, to the application for adjudging of the compensation must be enclosed complementary additional documents.

- certificate of work or service relations or studies or other reasons for the stay abroad;
- certificate of a competent establishment of the existence or non-existence of the right of the receipt of compensation in the crime execution country;
- application for the application of the missing basic and additional documents from abroad.
